1. Scope

This Acceptable Use Policy ("AUP") describes how customers and end-users may and may not use the Nuvi platform ("the Service"). It applies to all storefronts, content, automation flows, AI interactions, integrations, and outbound communications sent through the Service.

By using the Service, you (the "Customer") agree that you and your end-users will comply with this AUP. You are responsible for the conduct of users you grant access to your store, and for the content stored, transmitted, or sold through the Service under your account.

2. Prohibited Content

You shall not use the Service to host, sell, distribute, or link to content that: (a) infringes intellectual-property rights, including trademarks, copyrights, patents, and rights of publicity; (b) is defamatory, harassing, hateful, or threatens or incites violence against any person or group; (c) constitutes child sexual abuse material or exploits minors in any way; (d) is obscene, pornographic, or otherwise restricted by local law where the Customer or end-user is located; (e) facilitates the unlicensed sale of regulated goods or services (firearms, ammunition, explosives, controlled substances, prescription drugs, gambling services in jurisdictions where prohibited, human organs, counterfeit currency, fraudulent documents); (f) promotes or enables fraud, identity theft, or financial scams; (g) violates applicable export-control or sanctions laws.

Nuvi may, but is not obliged to, remove content that is reported as violating this AUP or that comes to our attention through any other means.

3. Prohibited Conduct

You shall not use the Service to: (a) gain unauthorized access to, scan, or probe the Service, other tenants, or third-party systems; (b) attempt to bypass any rate-limit, quota, isolation boundary, or access control; (c) reverse-engineer, decompile, or extract source code from the Service except to the extent permitted by mandatory law; (d) use the Service to distribute malware, viruses, ransomware, cryptominers, or any code intended to disrupt the operation of any system; (e) interfere with or disrupt the integrity, performance, or availability of the Service or any data hosted on it; (f) use the Service to send unsolicited bulk email (spam), unsolicited SMS, or any communication that violates applicable anti-spam laws (CAN-SPAM, GDPR, KVKK, e-Privacy Directive); (g) misrepresent the origin, authorship, or affiliation of content; (h) impersonate Nuvi staff or any other person; (i) use the Service to store or process personal data in violation of applicable data-protection law.

4. AI Assistant and Automation Use

Nuvi's AI assistant and automation features must not be used to: (a) generate content described as prohibited in Section 2; (b) attempt to extract Nuvi platform credentials, configuration, or other tenants' data; (c) automate harassment, mass impersonation, or political manipulation; (d) generate misleading product descriptions, fake reviews, or astroturfed testimonials.

Outputs generated by the AI assistant remain the Customer's responsibility. The Customer should review AI-generated content before publishing, particularly in regulated categories (food, cosmetics, financial services, health).

5. Email and Messaging Use

Customer-sent emails (transactional or marketing) and messages (SMS, WhatsApp, etc.) sent through the Service or its integrations must comply with applicable anti-spam law. The Customer must (a) maintain accurate sender identification, (b) honor opt-out requests promptly, (c) maintain documented consent for marketing recipients where required, and (d) not purchase or rent third-party email lists.

Nuvi reserves the right to throttle, suspend, or terminate sending privileges where deliverability metrics, complaint rates, or third-party blocklist signals indicate that sending volume is likely to cause harm to the platform's broader sender reputation.

6. Resource Use and Fair-Sharing

Each plan includes fair-use storage, bandwidth, and a performance/resource tier published on the pricing page. Nuvi may apply additional fair-use protections — such as request-rate limiting and burst-capacity caps — to preserve platform stability. Where a Customer's traffic profile materially exceeds patterns reasonably anticipated by the published plan, Nuvi may contact the Customer to discuss an Enterprise plan or a usage-based addendum.

7. Reporting and Enforcement

Suspected violations may be reported by email to [email protected] (planned) or [email protected]. Reports should describe the violating content or behavior, link to the storefront or asset where it appears, and provide any supporting evidence.

Where a violation is confirmed, Nuvi may, at its sole discretion and in proportion to the severity: (a) request the Customer to remove the offending content; (b) remove or disable the offending content; (c) suspend or limit the Customer's account; (d) terminate the Customer's account; (e) cooperate with law-enforcement and regulatory authorities.

8. Updates to This Policy

Nuvi may update this AUP from time to time. Material changes will be communicated to active customers by email at least 30 days before they take effect. Continued use of the Service after the effective date of an updated AUP constitutes acceptance of the change.
